This crime is regulated in the title dedicated to crimes against the Public Treasury and Social Security, specifically in article 305.1 of the Organic Law 10\/1995, of November 23, 1995, of the Penal Code (CP).<\/span><\/p><p><span style=\"font-weight: 400;\">Below, we would like to detail some essential aspects that you should know to avoid incurring in this serious crime.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c00a241 elementor-widget elementor-widget-heading\" data-id=\"c00a241\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Definition of tax crime\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6f7c601 elementor-widget elementor-widget-text-editor\" data-id=\"6f7c601\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Criminal Code establishes that a tax crime against the tax authorities is considered a tax crime when the tax benefit unduly obtained or the amount not paid exceeds 120,000 euros in each tax year, or when there is a taxable event that must be settled. This threshold, although high, is crucial to distinguish between a simple administrative error or infraction and a tax offense.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b3c9121 elementor-widget elementor-widget-heading\" data-id=\"b3c9121\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Limits for the European tax authorities\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bf56935 elementor-widget elementor-widget-text-editor\" data-id=\"bf56935\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">In the case of the European Inland Revenue, the limit is \u20ac100,000 in a calendar year, according to article 305.3 of the Criminal Code. This means that any fraud exceeding this amount in relation to European taxes will also be considered a tax offense.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8fe18e4 elementor-widget elementor-widget-heading\" data-id=\"8fe18e4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Requirements for the configuration of the tax offense\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5cbbeb5 elementor-widget elementor-widget-text-editor\" data-id=\"5cbbeb5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">For a tax crime to be committed, the following requirements must be met simultaneously:<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tax not paid: a tax has not been paid, a withholding has not been made, a refund has been obtained improperly or a tax benefit has been enjoyed that did not correspond.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Intent to defraud: There must be an intention to defraud.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Amount defrauded: The amount defrauded must exceed 120,000 euros per fiscal year and tax.<\/span><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-44d53f2 elementor-widget elementor-widget-heading\" data-id=\"44d53f2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Action of the Tax Administration: informing the Public Prosecutor's Office.\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6d28a0b elementor-widget elementor-widget-text-editor\" data-id=\"6d28a0b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">When the tax administration detects the possible commission of a tax offense, it must and forward the file, in accordance with Article 250 of Law 58\/2003, of December 17, 2003, General Tax Law (LGT). This ensures that, in the absence of fraudulent intent, it is not considered a crime even if the fraud exceeds 120,000 euros.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-72d1022 elementor-widget elementor-widget-heading\" data-id=\"72d1022\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Examples of punishable conduct<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cc7f21f elementor-widget elementor-widget-text-editor\" data-id=\"cc7f21f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Tax Authorities may consider that there is an intention to defraud in cases such as:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Concealment of income: Not declaring income obtained.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fictitious creation of tax benefits: Simulating non-existent expenses or benefits.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">False invoices: Issuing or using false invoices.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">In contrast, it will not be considered a crime if, for example, a company deducts expenses that are not tax deductible, but exist, since there is no intention to defraud.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d70fd49 elementor-widget elementor-widget-heading\" data-id=\"d70fd49\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Penalties for tax offenses\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-264fcbe elementor-widget elementor-widget-text-editor\" data-id=\"264fcbe\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The penalties for tax offenses can be very high and, in the case of individuals, can include prison sentences. In addition, although the possibility of initiating an inspection and sanctioning prescribes after four years, if there is a tax offense the statute of limitations is five years (ten years in the case of an aggravated offense).<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-54a6a98 elementor-widget elementor-widget-heading\" data-id=\"54a6a98\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Regularization to avoid risks\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b675671 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"b675671\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li><span style=\"font-weight: 400;\">To avoid incurring in a tax crime, it is essential to regularize your tax situation. If you wish to do it voluntarily:<\/span><\/li><\/ul><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You can file a complementary return: Satisfying the quota not paid before receiving a notification from the Treasury avoids penalties but does not eliminate the risk of tax crime if the amount exceeds 120,000 euros.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Form 770: For a complete regularization, in addition to the amount not paid, the surcharge for late payment and late payment interest must be paid.
