Sectores como el ocio nocturno, los alojamientos tur\u00edsticos, la restauraci\u00f3n, los cines y los clubes deportivos quedaron en suspenso. Sin embargo, a pesar de la par\u00e1lisis econ\u00f3mica, Hacienda, las diputaciones, los ayuntamientos y otros organismos recaudadores continuaron exigiendo el pago total de las cuotas del Impuesto de Actividades Econ\u00f3micas (IAE). En respuesta a esta situaci\u00f3n, numerosas empresas presentaron reclamaciones ante los tribunales.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En un fallo hist\u00f3rico, el Tribunal Supremo ha respaldado las reclamaciones de las empresas, ofreciendo una luz de esperanza en medio de la incertidumbre econ\u00f3mica:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Si bien es cierto que la falta de actividad durante el estado de alarma no exime el pago del IAE, el Tribunal reconoce que el impuesto se devenga el primer d\u00eda del a\u00f1o natural.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">No obstante, el Tribunal tambi\u00e9n ha destacado que el IAE contempla la reducci\u00f3n proporcional de la cuota en caso de paralizaci\u00f3n de la actividad por causas de fuerza mayor que duren m\u00e1s de 30 d\u00edas.<\/span><\/span>\n<p>\u00a0<\/p>\n<\/li>\n<\/ul>\n<p><b>Paralizaci\u00f3n de actividad<\/b><\/p>\n<p><span style=\"font-weight: 400;\">En consecuencia, el Tribunal Supremo establece que los cierres obligatorios provocados por los estados de alarma dan derecho a esa reducci\u00f3n del IAE. Lo m\u00e1s sorprendente es que las empresas no tienen que demostrar ni notificar a la Administraci\u00f3n dicha paralizaci\u00f3n, ya que estas circunstancias se derivan directamente de la ley. Solo es necesario justificar que la paralizaci\u00f3n fue total. Por ejemplo, en el caso de los negocios de hosteler\u00eda y restauraci\u00f3n, deber\u00e1 demostrarse que no se ofreci\u00f3 servicio de entrega a domicilio durante ese per\u00edodo.<\/span><\/p>\n<p><b>\u00bfC\u00f3mo reclamar?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Si te encuentras en esta situaci\u00f3n, es comprensible que desees explorar tus opciones para recuperar el IAE abonado. Sin embargo, antes de iniciar cualquier reclamaci\u00f3n, es importante verificar si tu ayuntamiento ya ha realizado alg\u00fan descuento en la cuota del impuesto por los d\u00edas de cierre. Algunos municipios implementaron medidas de alivio fiscal durante la crisis. Si no se ha otorgado ning\u00fan descuento, hay alternativas ante una liquidaci\u00f3n firme:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">En principio, impugnar el IAE a trav\u00e9s de los procedimientos especiales de revisi\u00f3n no parece viable. Estos procedimientos, como el recurso de revisi\u00f3n, la rectificaci\u00f3n de errores o la declaraci\u00f3n de nulidad, suelen tener requisitos espec\u00edficos que no se cumplen en este caso.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Sin embargo, es posible solicitar un procedimiento de revocaci\u00f3n de la liquidaci\u00f3n de IAE por infracci\u00f3n manifiesta de la ley y la devoluci\u00f3n del ingreso indebido. Aunque la revocaci\u00f3n suele ser iniciada por la Administraci\u00f3n, el Tribunal Supremo ha reconocido que los contribuyentes tambi\u00e9n pueden iniciarla en casos de infracci\u00f3n manifiesta de la ley.
