{"id":9029372,"date":"2021-05-12T00:00:19","date_gmt":"2021-05-11T23:00:19","guid":{"rendered":"http:\/\/gremicat.es\/presentar-renta-2020-2-2\/"},"modified":"2021-05-12T00:00:19","modified_gmt":"2021-05-11T23:00:19","slug":"teletrabajo-no-justifica-la-supresion-de-tickets-restaurante-3","status":"publish","type":"post","link":"https:\/\/www.gremicat.es\/en\/teletrabajo-no-justifica-la-supresion-de-tickets-restaurante-3\/","title":{"rendered":"Teletrabajo no justifica la Supresi\u00f3n de tickets restaurante"},"content":{"rendered":"<p style=\"font-size: 22px;\"><strong><span style=\"font-weight: 400;\">El teletrabajo no justifica la supresi\u00f3n de tickets restaurante durante el estado de alarma por Covid-19<\/span><\/strong><\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify; height: 40px; font-size: 20px; color: #e4003c;\"><\/h2>\n<h2 style=\"text-align: justify; height: 40px; font-size: 20px; color: #e4003c;\"><strong><b>La Sala de lo Social de la Audiencia Nacional, por sentencia de 9 de diciembre de 2020, ha establecido que es nulo suprimir los tickets de comida, incluso aun no habiendo acudido presencialmente al puesto de trabajo, durante el estado de alarma.<\/b><\/strong><\/h2>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Y el motivo es, precisamente, porque la supresi\u00f3n constituye una modificaci\u00f3n sustancial de las condiciones de trabajo.<\/p>\n<h3 style=\"text-align: justify; height: 40px; font-size: 20px; color: #e4003c;\"><strong><b>Cambios en las condiciones de trabajo:<\/b><\/strong><\/h3>\n<p>El cambio del r\u00e9gimen de jornada partida a jornada intensiva, con la consiguiente supresi\u00f3n del ticket comedor, es una modificaci\u00f3n sustancial de condiciones de trabajo que exige, para su adopci\u00f3n, que concurran causas econ\u00f3micas, t\u00e9cnicas, organizativas o de producci\u00f3n y un procedimiento espec\u00edfico. <strong>No justifican esta modificaci\u00f3n las especiales circunstancias derivadas del COVID-19 por la declaraci\u00f3n del estado de alarma y el cambio del sistema de trabajo a teletrabajo.<\/strong><\/p>\n<p>Los tickets-restaurante, o ayuda para la comida, <strong>es un beneficio social que disfruta el trabajador y la trabajadora, exactamente igual que un determinado seguro m\u00e9dico o guarder\u00eda, y son una forma de pago consolidada<\/strong>, o bien por convenio, o por acuerdo con los sindicatos que establezca el derecho a esta prestaci\u00f3n salarial.<\/p>\n<p>Por cada d\u00eda de trabajo efectivo,<strong>\u00a0<\/strong>la retribuci\u00f3n debe materializarse, con independencia de que este trabajo sea presencial o por teletrabajo, en el domicilio del trabajador, o en el lugar designado por este.<\/p>\n<p>(Sentencia Audiencia Nacional, Sala de lo Social, Secci\u00f3n 1, de 9 de diciembre de 2020, recurso n\u00ba 163\/2020)<\/p>\n<p><strong><span style=\"font-weight: 400;\">Para ampliar esta informaci\u00f3n consulte con <\/span><a href=\"http:\/\/www.gremicat.es\/asesoria-laboral-barcelona\/\"><span style=\"font-weight: 400;\">Asesor\u00eda Laboral\u00a0<\/span><\/a><\/strong><\/p>\n<div id=\"gtx-trans\" style=\"position: absolute; left: 399px; top: 844px;\"><\/div>\n","protected":false},"excerpt":{"rendered":"<p>El teletrabajo no justifica la supresi\u00f3n de tickets restaurante durante el estado de alarma por Covid-19 &nbsp; La Sala de <span>&#8230;<\/span><\/p>\n","protected":false},"author":1,"featured_media":9029373,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-9029372","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-sin-categoria"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.5 -
