La llei distingeix entre formaci\u00f3 necess\u00e0ria, volunt\u00e0ria i de prevenci\u00f3, i cadascuna t\u00e9 conseq\u00fc\u00e8ncies diferents.<\/span><\/p><p><span style=\"font-weight: 400;\">En el despatx portem setmanes atenent consultes sobre els cursos de formaci\u00f3 que organitzen les empreses. I a m\u00e9s, aquest temps compta com a treball.<\/span><\/p><p><span style=\"font-weight: 400;\">El motiu \u00e9s simple: el treballador no est\u00e0 fent una cosa aliena al seu \u00fas, sin\u00f3 complint amb ell. L&#8217;empresa t\u00e9 dret a exigir-ho i el treballador ha d&#8217;acudir, igual que acudeix a una reuni\u00f3 o a una tasca del dia a dia.<\/span><\/p><p><span style=\"font-weight: 400;\">Aix\u00f2 s\u00ed, ha de fer-se dins de l&#8217;horari laboral. Si s&#8217;organitza fora, l&#8217;empresa ha de pagar o compensar aquest temps. I a m\u00e9s, la llei diu clarament que no pot tenir cap cost per al treballador. Hi ha cursos que l&#8217;empresa ofereix perqu\u00e8 considera que poden ser \u00fatils -per exemple, idiomes, gesti\u00f3 del temps o lideratge-, per\u00f2 que no s\u00f3n essencials per al treball. En aquest cas, el treballador pot decidir si va o no. El descans no es toca. Ni per a una reuni\u00f3 ni per a una formaci\u00f3.<\/span><\/p><p><span style=\"font-weight: 400;\">Si el curs \u00e9s obligatori, es programa en horari de treball o es compensa. I si no ho \u00e9s, el treballador pot negar-se sense que aix\u00f2 li causi cap perjudici.<\/span><\/p><p><span style=\"font-weight: 400;\">A vegades les empreses ho fan amb bona intenci\u00f3 -&#8220;ja que estan lliures, que aprofitin&#8221;-, per\u00f2 legalment no se sost\u00e9.
