{"id":9025134,"date":"2016-05-11T08:31:43","date_gmt":"2016-05-11T07:31:43","guid":{"rendered":"http:\/\/www.gremicat.es\/?p=7768"},"modified":"2016-05-11T08:31:43","modified_gmt":"2016-05-11T07:31:43","slug":"baixa-voluntaria-treballador","status":"publish","type":"post","link":"https:\/\/www.gremicat.es\/ca\/baixa-voluntaria-treballador\/","title":{"rendered":"Baja voluntaria del trabajador"},"content":{"rendered":"<p style=\"text-align: justify;\">Si un trabajador decide finalizar voluntariamente su relaci\u00f3n laboral con la empresa, deber\u00e1 comunicar su voluntad de causar baja voluntaria con el preaviso m\u00ednimo estipulado en el convenio colectivo o, en su defecto, en el contrato de trabajo.<\/p>\n<p>[texto_central]<\/p>\n<p style=\"text-align: justify;\"><strong>\u00bfC\u00f3mo debe comunicar la baja voluntaria a la empresa?<\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">&#8211; <span style=\"text-decoration: underline;\">El trabajador deber\u00e1 preavisar a la empresa de su intenci\u00f3n de finalizar la relaci\u00f3n laboral.<\/span> Normalmente, el convenio colectivo establece un plazo de antelaci\u00f3n que suele ser, como m\u00ednimo de 15 d\u00edas, aunque tambi\u00e9n depende del grupo profesional del trabajador. En caso de que el trabajador no respetara ese plazo de antelaci\u00f3n, la empresa podr\u00e1 descontar del finiquito la parte proporcional al tiempo de preaviso no respetado.<\/li>\n<li style=\"text-align: justify;\">&#8211;\u00a0<span style=\"text-decoration: underline;\">Comunicar a la empresa la baja voluntaria por escrito, mediante entrega de una carta haciendo constar la fecha de comunicaci\u00f3n, la voluntad de causar baja en la empresa y la fecha de efectos de la misma<\/span>. Este documento ser\u00e1 una garant\u00eda para ambas partes: a) Para el trabajador, para acreditar el plazo de preaviso; y b) Para la empresa, para acreditar que la relaci\u00f3n laboral se ha extinguido por voluntad del trabajador.<\/li>\n<li style=\"text-align: justify;\">&#8211; Llegada la fecha de la baja voluntaria, la empresa deber\u00e1\u00a0entregar al trabajador su finiquito con la liquidaci\u00f3n correspondiente y tramitar su baja en la\u00a0Seguridad Social.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Las ausencias injustificadas no son bajas voluntarias<\/strong><\/p>\n<p style=\"text-align: justify;\">En ocasiones, cuando un trabajador deja de acudir a su puesto de trabajo de forma injustificada,\u00a0la empresa interpreta estas ausencias como una dimisi\u00f3n y procede a la extinci\u00f3n del contrato de trabajo como una baja voluntaria.<\/p>\n<p style=\"text-align: justify;\">Esta pr\u00e1ctica es incorrecta y puede conllevar, en caso de que el trabajador presentara una demanda, que la extinci\u00f3n fuera calificada como despido improcedente por parte del Juzgado de lo Social.<\/p>\n<p style=\"text-align: justify;\">Las ausencias injustificadas no pueden interpretarse como una baja voluntaria t\u00e1cita, sino que son causa justificadora de sanci\u00f3n disciplinaria que, seg\u00fan la gravedad, puede llegar a poder sancionarse con el despido disciplinario.<\/p>\n<p style=\"text-align: justify;\"><strong>Consecuencias de la baja voluntaria<\/strong><\/p>\n<p style=\"text-align: justify;\">La extinci\u00f3n de la relaci\u00f3n laboral por voluntad del trabajador tiene como una de sus principales consecuencias el hecho de\u00a0no tener derecho a percibir prestaci\u00f3n por desempleo.<\/p>\n<p style=\"text-align: justify;\">Para ampliar esta informaci\u00f3n consulta con <a href=\"\/asesoria-laboral-barcelona\/\">Asesor\u00eda laboral<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Si un trabajador decide finalizar voluntariamente su relaci\u00f3n laboral con la empresa, deber\u00e1 comunicar su voluntad de causar baja voluntaria <span>&#8230;<\/span><\/p>\n","protected":false},"author":1,"featured_media":9025135,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[868,1],"tags":[],"class_list":["post-9025134","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-laboral","category-sin-categoria"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.5 -
